What is the TCPA?

The Telephone Consumer Protection Act gives the Federal Communications Commission the right to stop unsolicited phone calls and artificial messages. The TCPA states that, unless you give express prior consents, callers:

  • Cannot call you before 8 a.m. or after 9 p.m. your time.
  • Must keep a Do Not Call (DNC) list of every consumer who has asked not to be called.
  • Must respect this DNC list.
  • Are required to give their name, identify whom they are calling for and a phone number or address of the person who you can contact.
  • Must not use any artificial voice or recording.
  • Cannot send an unsolicited fax.

The act does not require that all calls stop. Calls from market research companies, polling organizations, and non-profit, tax-exempt organizations are allowed, provided the caller follows the TCPA rules. These entities cannot use pre-recorded messages or auto-dialing.

TCPA remedies
